These Terms and Conditions are an agreement (“Agreement”) between you and Rain Giant, a division of Salesachievers, Inc., regarding your use of the information, software, products, and services contained in or available through the Rain Giant website. Rain Giant website is comprised of various web pages operated by Rain Giant. The Rain Giant website is offered to you conditioned on your acceptance of the terms, conditions, and notices contained herein. Your use of the Rain Giant website constitutes your agreement to all such terms, conditions, and notices, including the arbitration provision and class action waiver below.
Rain Giant offers a lead generation capture website for loan officers and real estate agents and does not provide any Mortgage or Real Estate Services. Rain Giant is not a Mortgage Company or Real Estate Agency, and the employees of Rain Giant are not acting as real estate agents / brokers.
Fees and Renewals
From time to time, we may offer different subscription terms, and the membership fees for such subscriptions may vary. The membership fees are non-refundable except as expressly set forth below.
Unless you notify us at support@raingiant.com BEFORE the monthly renewal date of your subscription, your subscription will automatically renew and you authorize us (without notice to you) to collect the applicable subscription fees, using any valid payment source we have on record for you.
Refund Policy
Rain Giant does not grant refunds. If you signed up for a free trial offer and you choose not to terminate your subscription before the trial period expiration date your credit card will be charged for the membership plan you selected. This transaction will recur every thirty days until the customer has requested cancellation. Customers must contact Rain Giant directly by email at support@raingiant.com to cancel the subscription.
Termination/Cancellation Options
You may terminate any plan at any time. If you cancel anytime before your next billing period no prorated fees are refunded.
If you fail to provide an on-time subscription payment, Rain Giant reserves the right to cancel your account. Rain Giant reserves its right to deem such failure to be a notice of cancellation and cancel your account. Any data within your account will be automatically deleted without notice at the time we cancel your account and the data cannot be retrieved.
Please note that termination/cancellation does affect your ability to access the website and all information associated. If you violate any of Rain Giant Terms and Conditions, Rain Giant reserves the right to terminate your Rain Giant subscription immediately. For termination for violation of the Terms and Conditions, there will not be a 90-day notice period and you will not continue to have access to Rain Giant website and services.
Modification of these terms of use
Rain Giant reserves the right to change the terms, conditions, and notices under which the Rain Giant website is offered, including but not limited to the charges associated with the use of the Rain Giant website.
You understand and agree that your use of Rain Giant after the date on which the Terms and Conditions have changed shall be treated as acceptance of the updated Terms and Conditions.
GENERAL
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Rain Giant as a result of this agreement or use of the Rain Giant website. Rain Giant performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Rain Giant's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Rain Giant website or information provided to or gathered by Rain Giant with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Rain Giant with respect to the Rain Giant website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Rain Giant with respect to the Rain Giant website. You may not assign or otherwise transfer the Terms and Conditions, or any right granted hereunder, without Rain Giant written consent. Rain Giant's rights under the Terms and Conditions are freely transferable by Rain Giant. Any failure by Rain Giant to enforce or exercise any provision of the Terms and Conditions, or any related right, shall not constitute a waiver of that provision or right. Any rights not expressly granted herein are reserved.
Rain Giant may provide you with notices, including those regarding changes to the Terms and Conditions, by email, regular mail, postings on the Rain Giant website, or other reasonable means now known or hereafter developed.
A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish of the parties that this agreement and all related documents have been drawn up in English.
